THE “PURPOSE OF DUTY” AND A MAJOR NEW APPROACH TO PROFESSIONAL NEGLIGENCE CLAIMS FROM THE SUPREME COURT

ABOUT THE SESSION

Earlier this year, the Supreme Court, consisting of seven justices, handed down judgment in two cases (Manchester Building Society v Grant Thornton UK LLP and Khan v Meadows).  These are two major decisions that will have a major impact on anyone who provides professional services and how claims should be approached.

The Supreme Court has created a new roadmap and provided guidance on this area of law that will have major ramifications.

This session will take you through the decisions of the Supreme Court and provide guidance on how providers of professional services should be taking steps now to mitigate the risk of claim being made against them, as well as looking at how the decisions will impact claims.

LEARNING OUTCOMES

By the end of the session, participants will be able to:

Identify the key elements of the two recent decisions in the Supreme Court

Recognise the legal principles as they now stand in professional negligence claims.  

Implement a strategy to mitigate the risk of claims being made against you as a professional advisor and deal with any claims that may arise.
